Terms of Service
These Terms of Service govern your access to and use of the Zensme platform, including zensme.com, the Zensme VR application, and all related services. By accessing or using the Platform, you agree to be bound by these Terms.
Eligibility
The Platform is intended ONLY for users 18 years of age or older. By creating an account, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into a binding contract, are not located in a jurisdiction where access to adult content is prohibited, and have completed our age-verification process. Creators must complete identity verification including government-issued photo ID, age verification (18+), §2257 record-keeping compliance, and tax documentation (W-9 for US persons; W-8BEN for non-US).
Account & Security
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity under your account. You must provide accurate, current, and complete information during registration. We may suspend or terminate accounts that violate these Terms. You may not transfer or sell your account.
Content & Conduct
Creators retain ownership of content they upload. By uploading content, you grant Zensme a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote your content on the Platform. You may NOT upload content depicting anyone under 18 years of age (zero tolerance — immediate termination + law enforcement referral), non-consensual content or content obtained through coercion, content that violates any person's privacy or publicity rights, content that infringes intellectual property rights, hate speech, harassment, or content that incites violence, or illegal content under applicable law.
Payments & Monetization
Creator revenue share and payout schedule are published on the Platform (currently 90% for Founding Creators, 80% standard). Payouts are via adult-friendly payment processors (CCBill, Segpay). All fan purchases are final except where required by law. Payment processing is handled by third-party processors. Zensme never stores full payment card details. Creators are responsible for all applicable taxes on earnings.
Intellectual Property
Zensme, its branding, logo, UI, and underlying technology are owned by Zensme. Creators retain all rights to their content, subject to the license granted above. To report copyright infringement under the DMCA, email dmca@zensme.com with identification of the copyrighted work, identification of the infringing material, your contact information, a good-faith statement, and a statement under penalty of perjury.
Privacy
Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your information as described therein.
Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, Zensme disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy or reliability of content, and uninterrupted or error-free service.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: Zensme shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages. Zensme's total liability for any claim is limited to the greater of: (a) the amount you paid Zensme in the 12 months preceding the claim, or (b) $100 USD. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Zensme, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your content, your use of the Platform, your violation of these Terms, or your violation of any law or third-party rights.
Termination
You may delete your account at any time through account settings. Content removal may take up to 30 days from all systems. We may suspend or terminate your account immediately for violation of these Terms, illegal activity or content, failure to complete verification, or risk of harm to the Platform or its users. Provisions that by their nature should survive termination will survive (including Sections on Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law).
Governing Law & Arbitration
These Terms are governed by the laws of the State of Delaware. Any dispute arising from these Terms or the Platform shall be resolved through binding arbitration administered by JAMS under its Comprehensive Arbitration Rules in Wilmington, Delaware. ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY — NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION. Either party may seek injunctive relief in court for intellectual property infringement.
§2257 Compliance
Zensme complies with 18 U.S.C. §2257 and 28 C.F.R. Part 75. All creators appearing in content on the Platform were at least 18 years of age at the time of creation. Age verification records are maintained by Zensme's Custodian of Records and are available for inspection by authorized government officials. For §2257 inquiries, contact: compliance@zensme.com.
Changes to These Terms
We may modify these Terms at any time. For material changes, we will notify users via email and/or Platform notification at least 30 days before changes take effect. Continued use after changes constitutes acceptance.
